a number of apartments and four-plexes and when police arrived, witnesses told them a man was standing in the street about a half a block away from that home shooting at a passing truck. >> a stray round from that shooting that actually entered this house of a totally innocent victim who was a woman standing in an upstairs bedroom that was hit by this stray round. it appears to be a very minor wound fortunately. >> reporter: the good news that woman just 31 years old is expected to recover but such a close call with a child in the home. antioch police tell us they've been doing extra enforcement in the neighborhood at least once a week trying to calm things down. they do believe that it has been effective. this morning they are still looking for that suspect but have not released any suspect description to us. reporting live in antioch, christie smith, "today in the bay." >> very scary there. meantime, we have new details this morning in an overnight shooting that has left one man dead, four others injured in

vallejo. that shooting happened late last night. police say they found two men shot inside a garage and they were rushed to a nearby hospital. one of those men later died. police say three other people also showed up at that hospital with gunshot wounds related to the same shooting. police at this point have not identified any suspects. happening now, the search for a former police officer turned shooting rampage suspect is spreading to mexico. investigators say he may have had help getting there. federal court papers uncovered by "the l.a. times" say an accomplice identified by the initials j.y. may have helped christopher dorner cross the bo border but mexico is just one of the places that dorner could be hiding and stress that dorner could be anywhere. also new this morning, security very tight at the u.s. consulate in thailand after reports of threats of a terror

attack. thai officials say that attack could come from al qaeda or other terrorists groups in that area but at this point will not specifically release any details about the threat. they stepped up security and it's expected to last until this weekend when a multinational military exercise in that area comes to an end. a follow-up to a story we brought you last night at 11:00. the white house is calling north korea's nuclear test highly provocative. north korea set up a small nuclear device at a test site. test was prompted by outrageous u.s. hostility. the u.n. security council is holding an emergency meeting today. president barack obama delivering his fourth state of the union address tonight. budget cuts, immigration reform and gun violence are the big three topics. the president expected to place an emphasis on how budget cuts will affect the middle class.

the speech starts at 6:00 p.m. pacific night. in a half hour from now, we'll take you live to washington, d.c. with more details on what the president is expected to say today and what congress is hoping to hear. we'll of course have complete coverage of the state of the union address on nbc bay area news at 5:00 followed by "nightly news." state of the union starts up at 6:00 and we'll have a complete wrap-up right here on nbc bay area news at 11:00 p.m. this is a surprise to a lot of dog owners. farmers insurance says it will no longer cover dog bite claims for certain breeds. "today in the bay's" bob redell tells us which breeds are affected and why the company is making the change. good morning, bob. >> reporter: good morning, laura. this is a move that could have dog owners not bringing dogs in public for fear if they were to bite someone or bite another dog or bring them to parks like here in san francisco. farmers insurance in recent weeks announced they'll no longer provide dog bite liability coverage for the following three breeds, pit

bulls, rottweilers and wolf hybrids. their contention is that 25% of all dog bite claims come from one of those three breeds. the insurance information institute says that in 2011 overall dog bite claims cost insurance companies almost $93 million in california. so there's the financial incentive for farmers insurance to try to limit their exposure. now over the past few weeks they have been requiring policy holders to sign waivers or if they refuse, their policy won't be renewed when it comes up for renewal. some customers told our sister station in sacramento that farmers should not be making a blanket decision to exclude these type of dogs. >> look at the individual owner that i think will be a better risk assessment. do they do obedience training. dog in general not breed. >> they have to manage the book of business. if they have seen an increase of claims because of dog bite liability by certainly breeds,

today. 38 in san jose right now. 31 degrees to start in gilroy. temperatures are crisp out there. we're basically going to see a repeat performance for monday. plentiful p.m. sun. through wednesday, temperatures start to warm up. two to three degrees. hazy sunshine on the way. and then toward the end of the week, we approach record territory. very warm temperatures for the middle of winter in the bay area. we'll talk about that. get the seven-day forecast ready in the next report. for today, 64 degrees inland. 62 degrees at the coast. it's a traffic tuesday. let's check your drive with mike inouye. >> good morning. it's traffic tuesday with changes for the south bay. first of all, the flashing lights at the bottom of the screen some sort of van just arrived on scene. i hope it's not a tv crew trying to show the onramp changes because this particular interchange has been the same for quite some time. there are no changes here except for volume of traffic. i will show you what's going on. maps northbound 101 there is slowing you see north of 680 and 280. that interchange. north on 280 and getting on 680 south at jackson or king, all of

those onramps. 13 of them extending toward baskum. metering lights will be switched on between 6:00 a.m. and 10:00 p.m. to help meter traffic on 280 making things easier for the flow on the freeway including connector from north 87 to north 280 in downtown freeway to freeway connector with metering lights now on as well. that will disrupt flow on the freeway and through downtown. we'll track that very heavy volume expected for this tuesday as is typical for tuesday. live looks outside show you how things are as far as volume at the bay bridge with those metering lights now on. backup building quickly past the end of the parking lot and coming down the east shore freeway westbound traffic. i saw flashing lights travel eastbound with taillights. i'll track down what else is going on in berkeley or richmond. back to you. coming up, the giants get a spring in their step. >> we want to come into this year and try to do the exact same thing and what we did last year is over with. >> wait until we tell you what

we'll check the forecast in just a bit with christina. it's 6:12. >> a color sandwich going on. worth looking at. 6:12 right now. time for a quick check of the day's top stories. chicago police found the suspects they were looking for. two gang members in the shooting death of a 15-year-old honor student who recently performed at president obama's inauguration. both of those suspects are being charged with murder. u.s. marshals say fugitive ex-police officer christopher dorner may now be in mexico. the website tmz says it has video of dorner buying scuba gear. dorner is accused of killing three people including a police officer in retaliation for being fired from the l.a. police force. president obama right now getting set to deliver his fourth state of the union address. that takes place tonight. he's expected to be focusing on budget cuts, gun violence and immigration reform. the president's speech starts at 6:00 locally here and will air live on nbc bay area. a huge fight is brewing

between one of america's foremost inventors and america's most important newspaper. >> a unique story. scott mcgrew, elon musk accusing "the new york times" of lying. >> it stems from a story in which a "the new york times" reporter drove a tesla model s sedan up and down the east coast and found in the cold the electric car had nowhere near the range advertised and it didn't work and had to be towed away. musk was furious. here's what he said to cnbc. >> "the new york times" has huge distribution and comes with a great deal of authority and i think for the most part that is warranted but there are times when it is not. there are times when "the new york times" has published articles that are less than accurate. it's a well known situation like that. i think unfortunately this is one of those cases. >> musk hinting at past "times"

errors like iraq's weapons of mass destruction and the whole jason blare covers. they say they will pull records from the data and prove "the new york times" is in his words faking the story. this is not the first time that tesla has complained after a reviewer said its cars came up short. tesla sued the british car program top gear after hosts were videoed pushing a tesla back into the garage they claimed it was out of electricity when in fact tesla later discovered the computers inside the car showed it still had half of its charge. one of these companies is going to have a lot of egg on its face. there's no halfway between this. somebody is not telling the truth and tesla says it will pull computer records and figure out who. >> interesting. thanks. >> we'll keep our eye on that one. 6:15 right now.

according to that calendar, first day of spring is weeks off. >> but our own giants players and of course the fans spring fever has already hit. today is the official report date for pitchers and catchers at spring training. laurence scott is live with a look at early arrivals preparing for cactus league action. good morning. >> reporter: it is great to be here early and for several reasons. last season on our giants clubhouse tv show we showed you the truck that left at&t park and took off and arrived here in scottsdale and that same truck took off about a week and a half ago. the gear got here just like three days ago or so. and we saw them unpacking the gear as the pitchers and catchers start reporting. the best thing we saw is position players are already around and the team comradery is already building. take a look. before the official report date for pitchers and catchers,

several giants have already made the scene including some position players like short stop brandon crawford. >> pitchers and catchers report but there are position players here. why is it so important for you to be here early? >> just to get back into the flow of things and just come and hang out with some of these guys and just kind of prepare for spring training. we have a lot of the same guys back from last year. it's like a reunion here coming back and everybody getting together and we're all real excited because like i said we have pretty much the same guys coming back. we hope to do the same thing. >> reporter: while equipment manager mike murphy and his staff were unpacking gear, the store was doing the same thing in preparation for crowds to arrive during cactus league play and work is just starting as a new season is finally upon us. >> what we did last year was awesome and great but we want to come into this year and do the exact same thing. what we did last year is over with. we got to come out here and perform well and not think that

teams are going to see we won last year and just let us win. >> reporter: matt kaine is right. competition in national league west will be strenuous this year and there's a lot of good signs that giants will be at the top of that heap. but the best thing when you see guys arriving early, it's not just that they arrive to the facility here in a couple days early each morning they get here early. pablo sandoval moments ago arriving for today's workout. great sign to see panda here early. it's just getting started. we're here on the scene very early. not just with the gear as they load it into the team store and the players are arriving, but to start bringing you great stories that will come out in the days ahead and later we'll have a story for you about some old friends and a furry friend that you got to meet. matt kaine's new furry friend. he's cool. he's cash. he's the man in black. he's a cocker spanspaniel.

>> if that doesn't get you psyched up for the season, i don't know what will. truck is there. players are there. it's all there. christina loren is here with us at 6:18 to tell you something to get you psyched up for weather outside. >> we hit that sweet stride. we'll keep on going. a great looking forecast. if you live in the bay area, you know winters can be dreary. we are getting so spoiled. this is such a beautiful shot. 6:18 now. that's phenomenal. yesterday morning we started out mostly clear. the only difference between yesterday and today is this additional low cloud cover hugging the immediate coast as we see that westerly flow today cool ocean air and nice sea breeze for us. just beautiful way to start the day. we'll have more of those live shots coming in all morning long. right now santa rosa a little bit of thick fog. ten miles of visibility or better. you want to travel cautiously through the north bay. once you head past the golden gate bridge through marin county it gets nice and clear.

64 degrees. that's about where we're headed today in warmest cities across the bay. north bay will be nice yet again. 34 in livermore. high pressure taking that storm track well to the north and for us offshore flow starts up and that means we're going to see warmer days even than what we already experienced yesterday and today. get ready for 70s. today we talk about low to mid 60s. even at the coast though beautiful sunny days ahead. that means you can take your valentine to the beach. 64 degrees in gilroy today. getting into the next few days, temperatures keep on climbing. the 70s in february, highly unusual especially in the middle of february. that's what we look forward to as we finish off the week. 6:20. let's check your drive. good morning, mike. >> we know that's your valentine's gift to us. we'll take it through the next few weeks. i looked and i did see flashing lights there. they cleared after just a few minutes.

no incidents reported by chp and no problems. here westbound for your compute toward the bay bridge good volume of traffic and at the bay bridge the metering lights and backup continue to build so we have a slow drive and folks over the 880 over crossing slow off the berkeley curve. you see slowing across the bridge from the incline up toward the s-curve as is typical build. metering lights keeping things moving smoothly once you get up toward that congestion treasure island into the city is easy. 880, 580 through oakland commute direction close to the limit. slow off north 238. earlier debris cleared from report without incident from chp. we do have slowing into hayward and continuing down into union city and fremont. typical patterns for that portion of the nimitz. 580 typical pattern slowing into livermore and out of livermore here approaching the dublin interchange. 680 will build volume through pleasanton and into sunol. we don't see slowing. just more cars heading into the south bay.

peak up. a live shot over san francisco. a spooky look but going to be nice. christina loren says wait for warm temps. it's 6:25. it's asian heritage night at the warriors game. houston rockets guard jeremy lin will take part in a question and answer session after the game. he's a palo alto graduate and former warrior. he's one of the very few asian americans ever to play in the nba. the warriors and rockets play tonight at 7:30 at the oracle arena. >> it's the new wave of sports teams all over. you have to have more uniforms to choose from in this modern era. next week the warriors will sport new threads on the court. check out new jerseys. compression there to show of flex appeal. tight to the body. warriors say they are 26% lighter than traditional jerseys.

today another first for president obama's second term. the state of the union address. this time around the president is taking time to shape his legacy. the speech is expected to touch on several hot button topics including gun control, immigration reform, jobs and the economy. beltway insider tracie potts joins us live on capitol hill this morning. first of all, tracie, good morning. let's talk about gun control. how serious is the president about efmphasizing it during ths address? >> so serious that you might say the president and democrats are bringing in reinforcements. in the first lady's box we'll see the parents of the chicago teen who participated in inauguration and then just a few days later was shot, gunned down on the streets in chicago. they are going to be special guests tonight along with people from the newtown, connecticut, shooting and other families of gun violence. the point here, they want

lawmakers especially republicans who are opposed to some of the president's initiatives to not only hear what the president has to say but to see the people affected by this. >> the administration says this is the year for immigration reform. do you think he'll cut republicans slack on the issue at all? >> if by slack you mean allow inaction and they don't get something done this year, no. they're going to push hard to get something done this time around. remember this is a promise that was not kept. president obama trying to hold onto those latino voters who supported him in droves back in november. but if by slack you mean compromise, that certainly is possible here. the president has made it pretty clear that he wants the 11 million undocumented workers in this country to have a way to become citizens and he's willing to beef up the border even more so if that's what it takes for republicans to go along with that. speaking of republicans, republican senator and immigration reform supporter

marco rubio said to be delivering a bilingual response to the president's address tonight. what does it say about where republicans stand on the issue? >> a couple of things. first of all, it says that they are very clear about having gotten only about 30% of the latino vote back in november and they're going after that voting block for the next two years and next four as well. and it says marco rubio is a rising star in the republican party. we hear his name over and over. we saw him introduce mitt romney at the convention. they are putting him out there as the new face of the party. >> they need to make some changes and we'll see what happens from there. okay. let's talk about jobs. what specifically is the president expected to push tonight? >> jobs, growth, the economy, infrastructure, other ways manufacturing jobs and investments that the government can make to try to spur those jobs in the private sector and the big focus, the big focus remember this for the white house is going to be the middle

class. you'll hear the president talk about that over and oef tonigve tonight. >> thank you. we continue our coverage now with business and tech reporter scott mcgrew. silicon valley will be sharing that spotlight at tonight's state of the union address. >> apple's tim cook as you pointed out will be obama family's guest tonight at the speech. sitting with the first lady. last year steve jobs' life attended. cook has been talking about manufacturing some apple computers back here in america. and one of the founders of biotech company council will be at the speech as well. a guest of south bay congressman mike honda. tracie was talking about immigration. four of the five founders of council are first generation americans as is congressman honda and the president himself on his father's side. according to joint venture silicon valley, half of all people working in silicon valley who have college degrees are

foreign born and if you look at engineers specifically, that jumps to 64%. you can make a valid argument that those statics say a lot about our education system more than anything else but for better or for worse, immigration will be crucial to silicon valley's success. >> this year the white house not only talking about technology but also using it to get its message across. >> ipad, iphone, on the web they have a new app and new streaming thing on youtube. we have a clip of that right here. >> you can watch this speech at white house.gov or at the white house app on ipad, iphone and android devices. to be part of the discussion, use twitter. >> this is a very hip, very high tech approach to the state of the union with charts and graphs on the right-hand side and then after the state of the union there will be people from the obama administration doing their spin on ipad and then throughout

here's a live look over the bay bridge. very thin marine layer this morning. it's going to get out of here very quickly as a result it is thin and we have high pressure moving in pushing winds offshore. santa rosa, watch out for pockets of fog elsewhere. ten miles or better in terms of your visibility. we stop the clock on future cast at 10:00 a.m. full sunshine over the greater bay area. that fog isn't going to last long at all. out of here by mid morning. as with he head through noon, full sunshine on the way. upper 50s inland breaking for lunch. 64 at 4:00 p.m. 63 bayside. and 62 at the coast. this is one of the cooler days in the extended period. wait until i show you that seven-day. let's check your drive. that is picking up right now. >> for sure. a note for folks traveling eastbound 80 heading out through berkeley in toward richmond. i have seen a second set of flashing lights going through that area passing university and north toward richmond over the last few minutes. again, they didn't really stop. they just paused around university avenue.

maybe looking for some debris. no reports on chp and they are patrolling through the area. smooth but heavy volume past the racetrack and down around the berkeley curve. speeds coming down into the 50s as you head through the area and continuing to build toward the toll plaza. metering lights on and slow up the incline to treasure island. slow out of the city in san francisco. eastbound lower deck. we're showing a smooth drive but continue to build through castro valley y north 238 and south 880 from hayward into fremont through union city with speeds into the 50s in spots where you see orange. we have 680 with build now in and out of pleasanton. south toward highway 84 things slow down specifically and in livermore and we'll check north bay quick look with low clouds drifting through san rafael with a smooth drive. not affecting your view of the roads. still ahead, we'll tell you about an olympic sport being dropped from the 2020 games. we'll let you know exactly which ones just ahead.

"today in the bay's" laurence scott is live in scottsdale, arizona, where early arrivals are reporting for what they call dugout duty. >> reporter: good morning. i tell you something, as we bring you these reports from scottsdale stadium, spring training home of the world champion san francisco giants, you want to thank back as pitchers and catchers report what it means to even have a spring training. you think back to legendary giants manager jon mcgraw. he brought them out to a hot water bath. things are different. these guys arriving to start working out. we're seeing them come in droves and we see old friends and some

new friends. take a look. >> reporter: the early arrivals are note worthy as the championship team reloads for a run at another world series title and getting a jump on competition gets start ed with getting back to business. >> guys like to show up early and get down to arizona and try to, you know, acclimate to the weather. a lot of guys come from east coast or tougher weather. they like to get in the sunshine. today is rainy. we have fun together. >> reporter: a laid back atmosphere noticeable as matt ca cain's new furry friend made friends. beyond the comradery, there are considerations for showing up early. >> i live in the north pole. i needed to get down here where it's warm. play catch a little bit. it's always fun to kind of, you come into the clubhouse and groomed fields and traping staff and all of the players.

was yesterday. talking about a repeat performance. low clouds at the coast will keep temperatures from soaring today. by tomorrow you can climb by two to three degrees. 65 degrees not too bad in livermore. 64 in gilroy. 63 in san jose. this is one of the cooler days in the extended period. taking you into thursday and friday getting closer to that 70-degree mark. in fact, on friday if you want to hit the beach, santa cruz i'm forecasting 73 degrees. it will be nice in santa cruz on friday. saturday and sunday temperatures in the upper 60s. comfortable days ahead. >> we'll keep it a secret. don't drive 17 to santa cruz where it will be beautiful this weekend. over here 17 beautiful right now. my focus is on 280 coming up toward us. that's the northbound side. you see a lot of headlights and you see folks bogging down a little bit coming off south 880 on north 280. that isn't so bad.

look at the map. we'll see how this plays out on the map. slowing developing right at the interchange. so weust see a stretch where it is slow. smooth on the rest of that stretch. this may be the result of some classes being out for the week. some schools are off. also this might be a result of metering lights turned on keeping people on city streets getting on 280 is slower now. 280 itself looks good. another issue is the build for the commute as well north 101 slow from capital to the airport. 87 really bogging down coming up to downtown. also a change for 87 connector from 87 north to 280 north is one of the onramps with metering lights on. that may add slowing north of alma. 85 slows as well. also of course you have tri-valley slowing for livermore and sunol south 680 with a new crash reported. getting word on information on lane blockage. slow at the area. slow 880 off 238 down in through union city and fremont. typical build there. bay bridge we have a backup.

metering lights are on. slow back to the berkeley curve. east shore freeway maintains the low 50s as you come through the area. and san mateo bridge, a look smooth drive westbound with the commute. no problem. there are low clouds christina was talking about. thin layer. you'll see low clouds drifting through the area but visibility is fine along the peninsula. developing story happening in the east bay. a stray bullet strikes a woman barely missing her young son and this one happens in the second story bedroom of her antioch apartment. it took place on sycamore drive near highway 4 and that is where "today in the bay's" christie smith is in live in antioch where police there are still searching for a suspect. >> reporter: good morning to you. one neighbor tells us that this home has actually been hit by stray bullets before and he was too afraid to go on camera and talk about it because it happened again. a woman was standing inside near a child when a bullet came right through the window and hit her in the arm. antioch police tell us that late

yesterday evening calls started pouring in gunfire in the street. this is an area of high density housing. a number of apartments and duplexes all together. when investigators arrived, witnesses told them that a man had been standing in the street about a half block away from that home shooting at a passing truck. >> there was a stray round from that shooting that entered this house of a totally innocent victim who was a man standing in an upstairs bedroom that was hit by the stray round. fortunately it appears to be a very minor wound. >> reporter: that woman 31 years old is expected to recover but such a close call with a child in the home. antioch police say they've been doing extra enforcement in the area at least once a week trying to calm things down. they do believe that it has been effective. this morning though they are still looking for that suspect and so far have not released a suspect description to us. reporting in antioch, christie smith, "today in the bay." new details this morning in

an overnight shooting that left one man dead and four others hurt in vallejo. the shooting happened just off i-80 and tennessee street. police found two men shot inside a garage and three victims who were able to drive themselves to the hospital. one of the men later died. police have not identified any suspects. and violence prompting changes to oakland's popular first friday art festival. during the last event, an 18-year-old student was shot and killed and three others were injured. the city says next month's events will be smaller and end earlier. the city also working with the event organizers to crack down on exactly how much alcohol is served. 6:53. all bets are off. san jose's casino matrix is suing the city to open the top flyer gambling room. marla tellez joins us live with more details on the lawsuit and why the city is refusing to open that top floor.

good morning. >> reporter: good morning. ultimately it was the outgoing san jose police chief chris moore who made that final decision to not allow casino matrix here to open up the top floor to that high stakes gambling. he cited safety concerns. concerned about the casino's ability to safely monitor activity on the top floor. now, as we reported just last month, it was san jose's gaming commission that recommended the denial ain the first place. now casino matrix is challenging the city of san jose slapping it with a lawsuit that cites a conflict of interest. the lawsuit was filed in santa clara superior court and federal court yesterday. it alleges the gaming division's administrator richard teng admitted that he does consulting work for other indian casinos, commercial casinos and racetracks. we spoke to a casino representative here about what the casino wants to come from

this suit. >> they have to change the structure of the division. that may mean that mr. teng may have to decide on whether he wants to work at the city or whether he wants to work for consultants. >> reporter: now according to the lawsuit, the casino wants the situation to be rectified for what it alleges to be unreasonable and malicious conduct, harassment and violation of civil rights. this morning we have reached out to both richard teng and the city of san jose waiting to hear back from both of them. san jose bay area contacted san jose city council members and say they can't comment on the case because they haven't seen the lawsuit just yet. an online search those that richard teng has been part of the gaming division for more than ten years. marla tellez, "today in the bay." a small east bay company is
